Emergency contact & waiver

The undersigned hereby represents:

1. The participant is an experienced player of the game of rugby football and/or flag rugby, and is familiar with the laws of the game.

2. The participant, parent or guardian is aware that playing rugby may result in injuries and that participant’s expose themselves to the risk of bodily injury or death through their participation in the game.

3. The participant wishes to participate in the play of rugby during the Lakefront 7s Rugby Tournament at Veterans Park, Milwaukee, WI.

4. The participant, parent or guardian agrees to waive any claim for damage, injury, or death arising out of this participation in the Lakefront 7s Rugby Tournament.

5. The participant, parent or guardian agrees to indemnify the tournament Organizing Committee, the Society for Cultivating Rugby Union Mastery, the referees and officials, the Milwaukee Barbarians, the volunteers, Veterans Park, and Milwaukee County Parks & their officers and directors and assigns, & all corporate sponsors (including, but not limited to, supporters and assigns) from any & all claims for damage or injury arising from his/her participation in the Lakefront 7s Rugby Tournament.

6. The participant, parent or guardian agrees that this waiver shall be binding upon the participant, his/hers representatives, heirs and assigns forever.

7. The participant, parent or guardian assumes all risks of damage, injury, or contracting infectious disease (such as MRSA, influenza and COVID-19) resulting from participation in the Lakefront 7s Rugby Tournament in accordance with the comparative negligence provisions under the Laws of the State of Wisconsin.

8. The participant, parent or guardian agrees that this waiver of liability also applies to any damages incurred to or loss of personal property while attending or participating in the Lakefront 7s Rugby Tournament.

9. The participant, parent or guardian agrees to avoid damaging property of Veteran’s Park except that normal damage which could be expected as a result of said Tournament, e.g. wearing down of turf.

10. The participant, parent or guardian acknowledges that any team or club fielding any player who has NOT signed this document, or fields a college player on a High School team, shall be summarily ejected from the tournament and any further play.

11. The participant, parent or guardian grants full permission to the Society for Cultivating Rugby Union Mastery all rights to use and authorize others to use their name, likeness, video, picture, voice, city and state of residence, biographical materials and any materials submitted in connection with this event for marketing and advertising purposes in perpetuity, and without need for compensation or royalty of any kind.

This agreement applies to any photographer, videographer, or other content creator (“Creator”) who captures photo, video, and/or audio content at or in connection with the Lakefront 7s Rugby Tournament at Veterans Park, Milwaukee, WI (“Event”).

1. ACKNOWLEDGEMENT OF RISK. The Creator is aware that rugby is a contact sport and that Event areas may involve hazards including fast-moving players, match balls, collisions, changing field conditions, and weather. The Creator is voluntarily attending the Event and assumes all risks of personal injury, illness, property damage, or other loss that may occur while the Creator is present at, traveling to/from, or working at the Event, including risks associated with infectious disease.

2. SAFETY, ACCESS, AND NON-INTERFERENCE. The Creator is required to comply with all Event safety rules and with all instructions from the Organizing Committee, venue staff, referees/match officials, medical personnel, security, and field marshals.

Without limiting the foregoing:

2.1. The Creator is required to remain off the field of play and outside any designated technical areas, in-goal areas, and touchlines unless expressly authorized by the Organizing Committee.

2.2. The Creator is prohibited from interfering with match play, match officials, tournament operations, or medical response at any time.

2.3. The Creator is prohibited from obstructing players, referees, assistant referees/touch judges, or team staff, including during substitutions, injuries, or stoppages.

2.4. The Creator is required to maintain situational awareness at all times and to keep tripods, monopods, bags, cases, cables, drones and other equipment clear of run-off areas, spectator paths, and emergency access routes.

2.5. The Creator is prohibited from using flash photography or lighting that could distract players or officials during live play.

2.6. The Creator is prohibited from entering restricted areas (including referee zones, medical/treatment areas, and team changing areas) without explicit permission from the Organizing Committee (and from the individuals involved where applicable).

2.7. The Creator is required to follow any additional field-specific rules communicated on-site, including any distance requirements from touchlines and in-goal areas.

3. EQUIPMENT & DRONES. The Creator is responsible for securing and supervising all equipment and for any damage, injury, or disruption caused by the Creator or the Creator’s equipment. The Creator is prohibited from operating drones over the field of play unless the Creator has received prior written approval from the Organizing Committee and the Creator is in compliance with all applicable federal, state, and local rules, permits, and insurance requirements.

4. CONTENT LICENSE. The Creator may capture photo/video/audio content at the Event (“Content”). The Creator retains ownership of the Content. The Creator grants the Society for Cultivating Rugby Union Mastery and the Lakefront 7s Organizing Committee, and their designees (collectively, “Event Parties”), a perpetual, irrevocable, worldwide, transferable, sublicensable, non-exclusive, royalty-free license to use the Content, in whole or in part, for Event and organizational purposes, including marketing, promotion, sponsorship fulfillment, fundraising, media/public relations, and archival use, in any format and channel now known or later developed, including social media, websites, email, broadcast, print, and paid advertising.

The Event Parties are permitted to edit, crop, caption, overlay graphics, and create derivative works from the Content, and are permitted to combine the Content with other materials.
Where practicable, the Event Parties will credit the Creator as [CREDIT NAME/HANDLE], and the Creator acknowledges that omission of credit will not be a breach.

5. CREATOR REPRESENTATIONS. The Creator represents and warrants that:

5.1. The Creator is the owner of the Content or otherwise has sufficient rights to grant the license described in this agreement.

5.2. The Creator is prohibited from intentionally capturing or distributing images/audio from private or restricted areas (including medical treatment areas or changing areas) without explicit permission from the Organizing Committee and the individuals involved where applicable.

5.3. The Creator is responsible for obtaining any necessary permissions for music, logos, graphics, or other third-party materials included in edited deliverables provided to the Event Parties, or for providing an alternate version without such materials upon request.

6. RELEASE OF CLAIMS / INDEMNITY. The Creator agrees to release, waive, and hold harmless the tournament Organizing Committee, the Society for Cultivating Rugby Union Mastery, referees and officials, the Milwaukee Barbarians, volunteers, Veterans Park, Milwaukee County Parks and their officers, directors, and assigns, and all Event sponsors/supporters (collectively, “Released Parties”) from any and all claims, demands, or causes of action arising out of or related to the Creator’s attendance at or activities in connection with the Event, including claims for personal injury, death, illness, property damage, or loss, except to the extent caused by the gross negligence or willful misconduct of a Released Party.

The Creator agrees to indemnify and defend the Released Parties from and against any third-party claims arising from (a) the Creator’s breach of this agreement; (b) the Creator’s negligence or misconduct; or (c) allegations that the Creator’s Content infringes intellectual property rights, violates privacy/publicity rights, or otherwise violates applicable law.

7. REMOVAL / REVOCATION OF ACCESS. The Creator acknowledges that the Organizing Committee is permitted to revoke the Creator’s credentials and/or remove the Creator from the Event (without refund or compensation) for unsafe behavior, interference with match operations, failure to follow instructions, or other conduct deemed disruptive or unsafe.

8. MISCELLANEOUS. The Creator agrees that this agreement is binding upon the Creator and the Creator’s heirs, representatives, and assigns. The Creator agrees that Wisconsin law governs this agreement, and that venue for any dispute shall lie in Milwaukee County, Wisconsin, unless otherwise required by law.
